Netizens questioned: children’s underwear advertising suspected of involving “soft pornography”

In the past two days, some netizens have posted on some social platforms, reflecting that some children’s underwear online stores on online shopping platforms are playing pornography.

“Japanese-style peach buttocks”, “Looking back and opening his mouth slightly”… Netizens pointed out that in the children’s clothing advertising pictures, not only a large number of female models are imitating adult postures, but even the shape of the reproductive organs of boys and girls is deliberately highlighted in the picture.

Some netizens believe that perhaps the business did not realize that this was a marginal ball of pornography, and did not expect that this may be used by people with intentions.

But more netizens think that the business is not innocent, “Even if this kind of store really does not have the idea of ‘soft pornography’, but what if even we ordinary people can detect that something is wrong and ‘pedophilia’ sees it?” “They’re still children, and it’s disgusting that the reproductive organs are all out of shape.” Of course, these netizens also believe that parents who allow their children to take such photos are also irresponsible.

On social platforms, netizens compiled a list of children’s clothing stores suspected of being involved in “soft pornography”, and in the conversation between netizens and the customer service of the business, the other party said: “People with unhealthy minds look dirty at everything.” ”

In response, the customer service of the “Xiaohei Tohuo Flagship Store” responded that “the store’s suspected related pictures and videos have been rectified”, “Multiduo’s intimate cotton” also said that the relevant pictures “have been processed and will no longer be sent”, while the “Funny Bird Flagship Store” did not respond.

Some netizens believe that according to the platform’s prohibited information management rules “Prohibited Goods and Information List & Corresponding Illegal Treatment”, these children’s underwear pictures comply with Article 7, paragraph 3, and are pornographic and vulgar pictures.

On the 18th, the reporter called the consumer service hotline of the e-commerce platform. The customer service staff said that a similar phenomenon has been noticed, the platform is undergoing rectification, and the supervision department will punish the merchant involved, and the specific punishment measures are not easy to disclose.

When the reporter asked whether the platform would review when the merchant uploaded pictures, the staff first said that it would review, then denied it, and then said that he was unclear about this aspect.

On the homepage of the platform, you can see the “Announcement on Launching a Crackdown on Online “Paid Deletion” and “Soft” issued on November 10 last year, which explains that in response to “soft pornography” information, the platform will further strengthen technical interception strategies, increase personnel review and online inspection, and focus on cracking down on all kinds of business entities on the platform that rely on “sexual innuendo” and “sexual provocation” to attract attention to earn traffic.

Lawyer: The photographer, uploader, and platform should all be liable

“First of all, the picture itself, whether pornography or erotica, is not allowed in the context of minors and is legally prohibited.” An Xiang, director of Beijing Dexiang Law Firm and deputy director of the Civil Law Committee of the Beijing Lawyers Association, said that “soft pornography” for minors violates both morality and law.

Many netizens believe that in this incident, parents, online stores, and shopping platforms have not properly protected these children, and they should bear certain responsibilities.

In this regard, An Xiang said that parents, schools, regulatory departments and the whole society, the protection of minors is a joint responsibility, which is a clear provision of the Law on the Protection of Minors. In the process of operation, enterprises and institutions should consider their own business behavior and whether the rights and interests of minors have been infringed.

Such pictures on shopping platforms, whether it is the subject of the picture or the minors who see the picture when purchasing these goods, constitute infringement.

An Xiang said that whether the consent of the guardian was obtained during the filming process is also worth paying attention to, if the guardian agrees to let the child take such photos in order to earn money, it is equivalent to seeking improper interests in a way that infringes on his own child, and the guardian itself has not performed the guardianship duty, and should be corrected by the relevant authorities and bear the corresponding legal responsibility.

From the perspective of civil liability, the lawyer said that if minors see these pictures and suffer physical and mental harm, their guardians can also request civil compensation from the producer of the pictures, the uploader and the platform manager.

In addition, advertisements must provide content in a healthy manner and must not infringe on the physical and mental health of minors, which is also a clear provision of the Advertising Law.

“From the producers of the pictures, the users of the pictures, to the managers of the final platform, these parties are responsible, and they should be investigated and dealt with by the market supervision department.” An Xiang said. (End)
